FundamenTELLE Health and its representative are not medical doctors, medical professionals, or mental health professionals, and do not give medical advice. Treatment is not a substitute for professional medical treatment or advice and does not purport to provide medical information or diagnoses. All the information shared by the fundamenTELLE Health Representative is his/her opinion and it should not be used in place of advice of my physician or medical professionals. It does not take into account any pre-existing medical conditions, interactions with any medication or medical treatment being undertaken by an individual advised or otherwise. It is recommended that clients seek professional medical advice before seeking treatment from fundamenTELLE Health and its representatives, and before implementing any recommendations given.

INDIVIDUAL SESSION BOOKING TERMS AND CONDITIONS
fundamenTELLE Health maintains a strict 24 hour cancellation policy which applies to all 1:1 consults and bookings. Bookings must be cancelled or rescheduled 24 hours prior to the session, or all payments are considered forfeited. Any reschedules must be used within 6 months of initial purchase. All gift vouchers, promotional consults or pre-bought consults must be used within 6 months of original purchase.

- Payment plans can be made available and will incur a small administration fee.
- It is each individuals responsibility to manage any food allergies or sensitivities they may have where events are catered.
- fundamenTELLE Health shall in no event be held liable for any loss or other damages including but not limited to special, incidental, consequential, or any other damages.
REFUND POLICY
If a client decides to cancel an event after payment has been made, transferring the clients space to another participant is allowed based on the following:
- if current participant sources the new participant, $50 admin fee applies
- if fundamenTELLE Health is asked to find the new participant, 10% admin fee applies
- if no replacement is found, full refund (excluding above fees) will be provided 6 weeks prior to the event, 50% refund will be provided 30 days prior to the event, no refund will be provided within 2 weeks of the event.
In the event other similar events are scheduled, a transfer can be offered, following the above replacement policy + any price difference.
No refund is given under unexpected circumstances that are out of fundamenTELLE Health's control. fundamenTELLE Health is not liable under the circumstances of natural disaster, war, pandemic, failure by the venue or other situation that is out of fundamenTELLE Health's control. fundamenTELLE Health will do their best to sort alternative arrangements depending on the scale of the situation.
CANCELLATION POLICY:
All information included in publicity is correct at the time of going to press, but may be subject to change. Whilst fundamenTELLE Health does not anticipate changes to the advertised event and retreat dates, we may for any reason deem it necessary to change the program dates, audience capacity, venue, speaker or hours without prior notice.
fundamenTELLE Health reserves the right to reschedule or cancel any event if we feel it is necessary and in the best interest for both parties (You, the attendee, and fundamenTELLE Health), this includes instances of Force Majeure.
We will notify you in writing no later than 30 days before the event is due to begin, except for Force Majeure, unusual or unforeseen circumstances outside fundamenTELLE Health's control. In which case, we will transfer your enrolment to another available date, or offer another program of equal value, to attend within 12 months. Monies paid will not be refundable and fundamenTELLE Health will not be held liable for any compensation.
LIVE EVENT INDEMNITY AGREEMENT
This is an Indemnity Agreement between You (the Client) and fundamenTELLE Health (ABN: 73660106785) of Canning Vale, WA, Australia 6155.
By attending the fundamenTELLE Essentials Detox Retreat, fundamenTELLE Breath and any other live and in -person event, I acknowledge and agree:
- It is your responsibility to arrive on time at the start of each session of the program. Missed content is not available after the event.
- Recording of any part of the program is strictly prohibited. Devices such as phones, voice recorders, cameras and video cameras must not be used during any program without the prior express written permission of fundamenTELLE Health.
- fundamenTELLE Health retains all intellectual property rights comprised in the patent, copyright, design, trade mark, eligible layout or similar right whether at common law or conferred by statute, and all rights to apply for registration under a statute in respect of those or like rights, including but not limited to goodwill, and rights to protect confidential information, trade secrets and know how, throughout the world for the full period of the rights and all renewals and extensions, in respect of any Program Content. Program Content includes all written work, artistic work, spoken word, audio recordings, video recording, live performances and presentations, and guest presentations. Program content must not be copied, reproduced or sold in any way without the express written permission of fundamenTELLE Health. Should you wish to use direct quotes from program content, whether for personal or commercial use, you agree to obtain written permission from fundamenTELLE Health before doing so.
- The program may be recorded or documented by fundamenTELLE Health or its authorised representatives for training and promotional purposes. You hereby authorise fundamenTELLE Health or its representatives to take photographs and audio/visual recordings of your participating in the program. You hereby grant to fundamenTELLE Health the exclusive rights to publish, broadcast, reproduce, transmit and communicate any recordings or photographs to the public, including as part of promotional or commercial materials. Please provide in writing express request to fundamenTELLE Health to NOT have your photos or similar utilised in this way.
- Program content is delivered for informational and educational purposes only. fundamenTELLE Health, its directors, officers, employees, agents and guests are not medical professionals and do not give medical advice. The program content is not a substitute for professional medical treatment or advice and does not purport to provide medical information or diagnoses. Content is not tailored to your individual needs, and does not take into account any pre-existing medical conditions, interactions with any medication or medical treatment being undertaken by any individual. fundamenTELLE Health recommends program participants seek medical advice before completing the program, and before implementing any recommendations or advice given during the program.
- Participation in the program does not confer upon attendees any qualification, certification or membership, and does not entitle attendees to hold themselves out as being affiliated with fundamenTELLE Health in any way.
- fundamenTELLE Health and its directors, officers, employees, agents, contractors, consultants, guests and representatives assume no responsibility or liability for any consequences, including any injury, death, damage, loss, delay, cost, expense or inconvenience arising directly or indirectly from your attendance at the program, or any action or inaction taken by you as a result of the information provided to you during the program.
- You irrevocably and unconditionally release, discharge and agree to forever hold harmless fundamenTELLE Health and its directors, officers, employees, agents, contractors, consultants, guests and representatives from any liability for any direct, indirect, consequential, or incidental damage, injury, death, loss, delay or inconvenience of any kind which may be occasioned by reason of any act or omission, including, without limitation, any wilful or negligent act of failure to act, or breach of contract.
- fundamenTELLE Health does not represent or guarantee that attendees of the program will experience any result or outcome by implementing any recommendation or advice provided during the program. The testimonials, case studies and examples used in the program are based on exceptional results to reflect the possibilities for self-healing. They may, but not necessarily, apply to the average person. They are not intended to represent or guarantee that anyone will achieve the same or similar results.
EXCLUSIONS:
Depending on the event being attended, expenses that MAY be excluded, depending on the event you are attending, include but are not limited to:

- Travel insurance
- Car hire
- Activities outside those stated as included in the event
TRAVEL AND HEALTH INSURANCE:
We recommend purchasing adequate comprehensive travel insurance for any event where travel and/or accommodation is required to attend a fundamenTELLE Health event.
It is the Attendee’s responsibility to ensure their travel insurance covers all expenses that may arise during travel including, but not limited to:
- Travel delay/cancellation
- Illness/personal injury
- Loss or damage
- Medical treatment
- Repatriation
- Force Majeure
- Other unforeseen circumstances
The participant should also provide a copy of their travel insurance to their emergency contact prior to departure.
BREATHWORK DISCLAIMER AND CONTRAINDICATIONS
When participating in breathwork exercises, clients understand they are doing so at their own risk and are responsible for monitoring their own health and ability levels. Clients are responsible for stopping the process at any time they feel unusual discomfort.
Clients agree and understand that it is advised to not partake in any alcohol or recreational drugs the day prior to any breathwork session.
Clients agree and understand that the following medical conditions mean they need to approach breathwork with caution and, should they choose to participate, need to do so in a slower pace than most people. Clients with a history of the below contraindications should consult their healthcare professional before participating in this work. This is the client’s responsibility.

- Cardiovascular disease, including angina or heart attack
- Uncontrolled high blood pressure
- Glaucoma
- Detached retina
- Kidney disease
- Severe asthma, lung or respiratory issues
- Severe diabetes
- Osteoporosis
- Significant physical injuries and/or undergone surgery within a few months prior to the event
- Severe mental illness, including bipolar, psychosis, or seizure disorders
- Epilepsy
- Aneurisms
FURTHER DISCLAIMER:
- Pregnant women and women on day 1-3 of menstruation are advised to not participate in any deep belly breathing activities or breath holds.
- Clients with asthma should bring their inhaler and consult with their primary care physical and facilitator before participating. Clients with infectious or communicable diseases such as Corona Virus or Flu like symptoms are asked to avoid attending group events due to the nature of group breathing and exercise.
- Breathwork will incorporate body work and physical touch from the facilitators in order to support energy flow through the body. Clients are responsible for advising the facilitators if this is something they are sensitive too.
- By undertaking breathwork with fundamenTELLE Health, clients understand that these practices are not a substitute for psychotherapy or medical care and that it is recommended that you work with a GP for any conditions held.
- Clients fully understand that by participating, these practices will include connected, circular breath, physical movement, therapeutic touch and body work, meditation, sound & release of emotions. Clients understand that conscious connected breathwork gives an opportunity to release any chronic muscular tension and free flow of energy in the body.
The fundamenTELLE Health Representative and their officers, employees, agents, contractors, consultants and representatives assume no responsibility or liability for any consequences, including any injury, death, damage, loss, delay, cost, expense, or inconvenience arising directly or indirectly from advice, opinions, or any action or inaction taken by clients as a result of the information provided to them or by participation in the session.
AFFILIATE PROGRAM TERMS AND CONDITIONS
By participating in the fundamenTELLE Health Affiliate Program, affiliates agree to:

By participating in the fundamenTELLE Health Affiliate Program, affiliates agree to:
- Payments will be made at the start of each month once a minimum of $50 has been earnt.
- Payments will be made via direct transfer into an Australian account or via PayPal for overseas affiliates.
- All payment transfer fees, including PayPal, will be absorbed by the affiliate.
- fundamenTELLE Health’s designs, assets, logos, and all associated material is shared as a sign of goodwill and is to be used by affiliates for marketing purposes only. Copyright applies.
- It is the affiliates responsibility to ensure all promotional material is accurate and contains no false, misleading or inaccurate information.
- It is the affiliates responsibility to ensure all affiliate links are used correctly by potential clients. fundamenTELLE Health takes no responsibility if potential commission is lost due to incorrect use of affiliate links.
- Affiliation only applies to the items listed in the affiliate portal. For example, items purchased via Tyler Tolman and Tolman Health will not receive commission.
- Under no circumstances is an affiliate allowed to offer any form of bonus offers, discounts or promotions to their leads without the express consent of fundamenTELLE Health. This is a violation of our terms of use and the affiliate responsible for this will be subject to having their account blocked with no refund and no right to appeal.
- The affiliate must not use negative content to discredit products or services sold by other companies in order to promote fundamenTELLE Health. This includes, but is not limited to the use of comments, advertisement products or services by the company as a “scam”, “fraud”, “false”, “sucks”, or any other synonyms or phrases that convey the same meaning.
- Spam is absolutely prohibited. We characterise spam as intrusive, repetitive, and promotional messages sent without the consent or request of the recipient by any means of communication. It is also considered spam to place your ads or product links in the posts, videos, or ads of others.
